PLEASE READ CAREFULLY — THIS IS A LEGAL DOCUMENT THAT
AFFECTS YOUR RIGHTS.
This KB-90 Client Waiver + Consent Packet (“Agreement”) is entered into between you (“Participant,” “Client,”
“I,” “me”) and KB-90, including its owners, officers, directors, employees, affiliates, successors, assigns, and
representatives (“KB-90”).
By selecting “I Agree” or otherwise electronically accepting this Agreement, I acknowledge and agree as
follows:
1) VOLUNTARY PARTICIPATION
I understand that I am voluntarily participating in the KB-90 fitness training and coaching program (“KB-90
Program”), which may include:
• strength training (including kettlebells and resistance training)
• conditioning, HIIT, cardio, intervals, circuits
• mobility, stretching, flexibility work
• coaching, education, and fitness instruction
• general nutrition education and lifestyle coaching
I understand KB-90 is a remote coaching and education program and is not a medical provider.
2) REMOTE COACHING / VIRTUAL TRAINING ACKNOWLEDGMENT
I understand that KB-90 training is conducted remotely (virtually). KB-90 trainers/coaches may not be physically
present and may not be able to physically assist, stabilize, correct, or spot me during exercises. I acknowledge
that:
• I am responsible for safely following instructions and choosing appropriate weights/resistance.
• Coaching and cues may be delivered verbally and/or visually through video, text, or app tools, but execution
remains my responsibility.
• I will stop immediately if I feel unsafe, unstable, lightheaded, or in pain.
• I accept that remote training carries additional risks compared to in-person supervision.3) ASSUMPTION OF RISK
I understand and acknowledge that fitness training involves inherent risks, including but not limited to:
• muscle strains, sprains, soreness, tears, cramps
• joint injury (including knees, shoulders, hips, back)
• falls, loss of balance, dizziness, fainting
• overexertion
• dehydration / heat illness
• fractures, serious injury, permanent disability
• heart attack, stroke, or death
I understand these risks may result from my own actions or inactions, the actions or inactions of others,
equipment failure, my training environment, or other causes.
I knowingly and voluntarily assume all risks, known and unknown, foreseeable and unforeseeable, related to
participation in the KB-90 Program.
4) HOME ENVIRONMENT + EQUIPMENT DISCLAIMER (REMOTE
TRAINING)
I understand KB-90 is a remote (virtual) coaching program. All workouts and training sessions are completed in
my own environment (such as my home or another location of my choosing). I acknowledge and agree:
• I am solely responsible for selecting a safe training area appropriate for exercise.
• I am solely responsible for the setup, maintenance, and safe use of any equipment I use (including equipment
KB-90 recommends I purchase).
• KB-90 does not own, manage, inspect, supervise, or control my training location or equipment.
• KB-90 cannot guarantee that my environment is free from hazards (including uneven surfaces, slippery floors,
inadequate space, pets/children nearby, improper equipment setup, or other conditions).
I accept full responsibility for ensuring my training environment and equipment are safe before beginning any
workout.
5) MEDICAL STATUS + CLIENT RESPONSIBILITIES
I represent and warrant that:
• I am physically able to participate in exercise.
• I have consulted with a licensed physician if needed.
• I have disclosed any injuries, limitations, medical conditions, pregnancy status, and/or medications that may
affect participation.
• I understand it is my responsibility to stop and immediately notify my coach/trainer if I experience pain,
dizziness, shortness of breath, chest discomfort, or other concerning symptoms.
I understand KB-90 does not provide medical diagnosis or medical treatment and is not responsible for
determining my medical fitness for exercise.6) INFORMED CONSENT
I understand the KB-90 Program includes coaching, training instruction, and education. I understand that:
• exercise responses vary by individual
• modifications may be recommended, but participation and execution remain voluntary
• I am responsible for selecting safe weights/resistance and appropriate intensity
I consent to participate in physical exercise and fitness training activities as part of the KB-90 Program.
7) RELEASE OF LIABILITY (RELEASE OF CLAIMS)
To the maximum extent permitted by law, I hereby RELEASE, WAIVE, DISCHARGE, and COVENANT NOT
TO SUE KB-90 from any and all liability, claims, demands, causes of action, damages, losses, or expenses
arising out of or related to:
• any injury, disability, illness, or death
• any property loss, theft, or damage
• any act, omission, or negligence (whether passive or active) of KB-90
• participation in any KB-90 session, workout, plan, educational materials, or recommendation
This release applies to all participation conducted at any location I choose (including my home), and through
any format including video, app, phone, email, text, messaging, or other remote communications.
8) INDEMNIFICATION / HOLD HARMLESS
I agree to DEFEND, INDEMNIFY, and HOLD HARMLESS KB-90 from and against any claims, lawsuits,
liabilities, damages, costs, or attorney’s fees arising from or related to:
• my participation in the KB-90 Program
• my actions or omissions
• any misrepresentation I have made in this Agreement
• my failure to follow KB-90 safety instructions or modifications
• my use or misuse of equipment and/or my environment while exercising
9) TRAINER CREDENTIALS + INSURANCE DISCLOSURE
KB-90 requires its personal trainers/coaches providing services through the KB-90 Program to hold current
certification(s) from nationally recognized fitness certification organization(s) and to maintain personal
professional liability insurance appropriate for personal training/coaching services.
I understand, however, that certification and insurance do not eliminate the inherent risks of exercise, and I still
assume full responsibility for my participation and safety while performing workouts.
10) INDEPENDENT TRAINER / CONTRACTOR RELATIONSHIP
I understand and agree that KB-90 personal trainers and coaches may provide coaching services as
independent contractors and are not employees, agents, or partners of KB-90.
I understand KB-90 provides a coaching platform and program structure, but trainers/coaches may operate
independently, including maintaining their own professional certifications and insurance coverage.I acknowledge that KB-90 is not responsible for any acts or omissions of trainers/coaches that fall outside the
scope of KB-90 Program guidelines, policies, or published training methods.
11) NUTRITION / EDUCATION DISCLAIMER (NOT MEDICAL ADVICE)
I understand that any nutrition guidance, food suggestions, macro targets, meal planning tools, or educational
information provided through KB-90 are for general informational and educational purposes only.
I understand KB-90 does not provide medical nutrition therapy and does not diagnose, treat, cure, or prevent
disease.
I acknowledge that I am responsible for my nutrition decisions and that I should consult a physician or qualified
healthcare provider regarding medical conditions, allergies, or dietary restrictions.
11A) AI MEAL PLANNING / AUTOMATED RECOMMENDATIONS
DISCLAIMER
I understand KB-90 may provide access to AI-powered or automated tools (including an AI meal planner) that
generate suggested meals, macro targets, and nutrition recommendations based on the information I provide.
I understand and agree that:
• AI-generated outputs are informational and educational only and may contain errors, omissions, or unintended
suggestions.
• KB-90 does not guarantee the accuracy, completeness, or suitability of AI-generated outputs for my personal
health needs.
• I am responsible for verifying all meal plans and food recommendations, including calories/macros,
ingredients, allergies, intolerances, and dietary restrictions.
• I will consult a physician or qualified healthcare provider before making dietary changes if I have any medical
condition, pregnancy, or medication-related restrictions.
I understand that I should never rely on AI-generated outputs for medical decisions.
12) NO GUARANTEE OF RESULTS
I understand KB-90 makes no guarantees regarding outcomes, including fat loss, muscle gain, strength
improvements, performance outcomes, or health changes.
13) PHOTO / VIDEO / RECORDING (COACHING PURPOSES)
I understand KB-90 may record virtual sessions for coaching, quality control, and trainer development. Such
recordings may include audio/video of me.
KB-90 will not publish or publicly share recordings that identify me without my separate written permission,
unless I otherwise agree.
14) OPTIONAL PHOTO / TESTIMONIAL RELEASE (SEPARATE OPT-IN)
OPTIONAL CONSENT - CHECK ONLY IF YOU AGREE:
[ ] I grant KB-90 permission to use my name, likeness, images, video, voice, workout results, testimonials,
and/or transformations for marketing and promotional purposes (including website and social media), without
compensation.I understand I may request revocation of future use in writing, but KB-90 cannot revoke use already published
prior to revocation.
15) EMERGENCY ACKNOWLEDGMENT
I understand KB-90 trainers/coaches are not physically present and cannot provide emergency medical
services. I acknowledge it is my responsibility to contact emergency services (911 in the U.S.) if needed.
16) DIGITAL SIGNATURE / ELECTRONIC CONSENT
I consent to signing this Agreement electronically. I agree that:
• selecting “I Agree,” clicking acceptance, typing my name, or any other digital acceptance method constitutes
my legal signature
• a digital record of acceptance, including date/time stamp and IP/device data where applicable, may be used
as evidence of my execution of this Agreement
• this Agreement is enforceable as a written, signed contract
17) GOVERNING LAW / VENUE
This Agreement shall be governed by the laws of the State of California. Any dispute shall be brought
exclusively in the appropriate courts located in Los Angeles County, California.
18) SEVERABILITY
If any provision of this Agreement is held invalid or unenforceable, the remaining provisions shall continue in full
force and effect.
19) ACKNOWLEDGMENT OF UNDERSTANDING
I certify that:
• I have read this Agreement fully

• I understand I am waiving substantial legal rights, including the right to sue
• I accept it freely and voluntarily

PLEASE READ CAREFULLY — THIS IS A LEGALLY BINDING
AGREEMENT.
This KB-90 Client Terms & Conditions (“Agreement”) is entered into between you (“Client,” “Participant,” “I,”
“me”) and KB-90, including its owners, officers, directors, employees, affiliates, successors, assigns, and
representatives (“KB-90”).
By selecting “I Agree” or otherwise electronically accepting this Agreement, I acknowledge and agree as
follows:
1) PROGRAM DESCRIPTION
KB-90 is a remote (virtual) fitness coaching and education program. Services may include:
• fitness training programming
• remote coaching sessions and/or check-ins
• educational content related to training, nutrition, and lifestyle
• access to KB-90 tools, templates, and digital resources
2) ELIGIBILITY
To participate in KB-90, I confirm that:
• I am at least 18 years old (or have legal parent/guardian consent where required)
• I am able to participate in exercise
• I will provide accurate onboarding information
3) CLIENT RESPONSIBILITIES
I agree that I will:
• follow training instructions responsibly
• use safe exercise form and appropriate loads
• stop immediately if I experience concerning symptoms
• keep my environment safe for training
• communicate respectfully with KB-90 coaches/trainers and staff4) TRAINERS ARE INDEPENDENT CONTRACTORS
Clients acknowledge that KB-90 coaches/trainers providing services through KB-90 may be independent
contractors. Nothing in this Agreement shall be interpreted as creating an employment relationship, partnership,
joint venture, or agency relationship between KB-90 and any trainer/coach.
5) SCHEDULING / SESSIONS (IF INCLUDED)
If my membership includes live coaching sessions:
• scheduling is subject to availability
• sessions may be delivered via digital methods
MISSED SESSION POLICY (STANDARD)
If I miss a scheduled session without proper notice, it may be forfeited at KB-90’s discretion.
6) COMMUNICATION POLICY
KB-90 may provide coaching communication via app messaging, email, text, voice notes, or video calls.
KB-90 does not guarantee immediate responses outside scheduled sessions.
7) BILLING, PAYMENTS & SUBSCRIPTIONS
I authorize KB-90 (or its payment processor, including Stripe) to charge my payment method on a recurring
basis according to the plan I selected.
8) CANCELLATION POLICY (SUBSCRIPTIONS)
Clients may cancel their subscription at any time through the KB-90 platform and/or Stripe customer billing
portal.
To avoid a renewal charge for the next billing cycle, cancellation must be submitted at least twenty-four (24)
hours before the next scheduled billing date.
If cancellation is submitted fewer than 24 hours before the next billing date, the subscription may renew for the
next billing cycle and will then be set to cancel at the end of that renewed cycle.
Cancellations take effect at the end of the current paid billing cycle unless otherwise stated in writing. No partial
refunds are provided for unused time within a billing period.
9) REFUNDS
Unless otherwise stated in writing, all payments are non-refundable once processed.
10) CHARGEBACKS / PAYMENT DISPUTES
I agree to contact KB-90 first before initiating a chargeback or payment dispute. Improper chargebacks may
result in termination of access.
11) PROGRAM ACCESS / PLATFORM AVAILABILITY
Temporary downtime may occur due to updates, maintenance, platform outages, or internet issues.12) INTELLECTUAL PROPERTY
All KB-90 materials are proprietary. I agree I will not reproduce, distribute, sell, share, or publish KB-90
materials.
13) CLIENT CONDUCT
KB-90 may suspend or terminate access for harassment, fraud, or redistribution of materials.
14) DISCLAIMERS
KB-90 is not a medical provider and does not diagnose, treat, cure, or prevent disease.
15) LIMITATION OF LIABILITY
To the maximum extent permitted by law, KB-90’s total liability for any claim related to this Agreement shall not
exceed the amount I paid KB-90 in the prior 30 days (or prior billing cycle), whichever is greater.
16) TERMINATION
KB-90 may terminate or suspend access for violations or non-payment.
17) GOVERNING LAW / DISPUTE RESOLUTION
This Agreement shall be governed by the laws of the State of California. Any dispute shall be brought
exclusively in the appropriate courts located in Los Angeles County, California.
18) DIGITAL SIGNATURE / ELECTRONIC CONSENT
Electronic acceptance constitutes legal signature.
19) ACKNOWLEDGMENT
I have read and accept this Agreement.
